1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or when you contact us.
The personal information we collect may include the following:

- Debit/credit card numbers
- Sensitive information. We do not process sensitive information.
Social media login data. We may provide you with the option to register using your existing social media account details (such as Facebook or X). If you choose to do this, we will collect certain profile information from the social media provider, as described in Section 7.
All personal information you provide must be true, complete, and accurate. Please notify us of any changes.
Information automatically collected
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and information about how and when you use our Services. This information is primarily needed to maintain the security and operation of our Services and for internal analytics.
Like many businesses, we also collect information through cookies and similar technologies. The information we collect includes:
Log and usage data. Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services — including your IP address, device information, browser type, activity data (date/time stamps, pages viewed, searches), and device event information.
Device data. Information about your computer, phone, tablet, or other device, including IP address, device and application identification numbers, location, browser type, hardware model, internet service provider, operating system, and system configuration.
Location data. We collect location data such as information about your device's location, which can be precise or imprecise. You can opt out by refusing access or disabling your location settings, though this may affect certain features of the Services.
Google API. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
2. HOW DO WE PROCESS YOUR INFORMATION?
We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes only with your prior explicit consent.
We process your personal information for the following reasons:

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?
We only process your personal information when we believe it is necessary and we have a valid legal reason to do so — such as with your consent, to comply with laws, to provide you with services, to fulfill contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

We may process your information if you have given us specific permission (express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (implied consent). You can withdraw your consent at any time by contacting us.
In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including:
- If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
- For investigations and fraud detection and prevention
- For business transactions provided certain conditions are met
- If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
- For identifying injured, ill, or deceased persons and communicating with next of kin
- If we have reasonable grounds to believe an individual has been, is, or may be a victim of financial abuse
- If collection and use with consent would compromise the accuracy of the information and collection is reasonable for purposes related to investigating a breach of an agreement or contravention of Canadian law
- If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court
- If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced
- If the collection is solely for journalistic, artistic, or literary purposes
- If the information is publicly available and specified by the regulations
- We may disclose de-identified information for approved research or statistics projects, subject to ethics oversight and confidentiality commitments
4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
We may need to share your personal information in the following situations:
- Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business.
Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs to retrieve location-specific information. We obtain and cache your location data on your device. You may revoke your consent at any time by contacting us. Google Maps uses GPS, Wi-Fi, and cell towers to estimate your location.
5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some tracking technologies help us maintain security, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.
We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements and tailor them to your interests.
To the extent these tracking technologies are deemed a "sale" or "sharing" under applicable US state laws, you can opt out by submitting a request as described in Section 13.

Google Analytics
We may share your information with Google Analytics to track and analyze the use of the Services. Google Analytics Advertising Features we may use include Remarketing with Google Analytics, Google Display Network Impressions Reporting, and Google Analytics Demographics and Interests Reporting.

6. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?
As part of our Services, we offer products, features, and tools powered by artificial intelligence, machine learning, and similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. This Privacy Policy governs your use of the AI Products within our Services.
Use of AI technologies
We provide the AI Products through third-party service providers ("AI Service Providers"), including Anthropic, ElevenLabs, and OpenAI. Your input, output, and personal information will be shared with and processed by these AI Service Providers as outlined in this Privacy Policy and in Section 4. You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.
Our AI products
Our AI Products are designed for the following functions:
- AI automation — including inbound call handling, outbound lead callbacks, SMS follow-up, website chat, and lead capture
- How we process your data using AI
- All personal information processed using our AI Products is handled in line with this Privacy Policy and our agreements with third parties. This ensures high security and safeguards your personal information throughout the process.

7. HOW DO WE HANDLE YOUR SOCIAL LOGINS?
Our Services offer you the ability to register and log in using your third-party social media account details (such as Facebook or X). Where you choose to do this, we will receive certain profile information from your social media provider — typically including your name, email address, friends list, and profile picture, as well as other information you choose to make public.
We will use this information only for the purposes described in this Privacy Policy. We do not control and are not responsible for other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information.
8. HOW LONG DO WE KEEP YOUR INFORMATION?
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it. If deletion is not immediately possible (for example, because your information has been stored in backup archives), we will securely store your personal information and isolate it from any further processing until deletion is possible.
9. HOW DO WE KEEP YOUR INFORMATION SAFE?
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.
Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
10. DO WE COLLECT INFORMATION FROM MINORS?
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 years old or that you are the parent or guardian of a minor and consent to that minor's use of the Services.
If we learn that personal information from users under 18 has been collected, we will deactivate the account and take reasonable measures to promptly delete such data. If you become aware of any data we may have collected from children under 18, please contact us at marie@hartworkai.com.
11. WHAT ARE YOUR PRIVACY RIGHTS?
Depending on your state of residence in the US or in some regions such as Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.
In some regions (like Canada), you have certain rights under applicable data protection laws, including the right to: (i) request access and obtain a copy of your personal information; (ii) request rectification or erasure; (iii) restrict the processing of your personal information; (iv) data portability where applicable; and (v) not be subject to automated decision-making. Where a decision is made solely by automated means that produces legal or similarly significant effects, we will inform you, explain the main factors, and offer a simple way to request human review.
To make a request, contact us using the details in Section 15. We will consider and act upon any request in accordance with applicable data protection laws.
Withdrawing your consent
If we are relying on your consent to process your personal information, you have the right to withdraw that consent at any time by contacting us. Please note that withdrawing consent will not affect the lawfulness of processing before its withdrawal, nor will it affect processing conducted on other lawful grounds.
Opting out of marketing communications
You can unsubscribe from our marketing and promotional communications at any time by clicking the unsubscribe link in any email we send, replying "STOP" or "UNSUBSCRIBE" to any SMS we send, or by contacting us. You will then be removed from marketing lists. However, we may still communicate with you for service-related purposes necessary for the administration and use of your account.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent — this information will not be shared with third parties.
Cookies and similar technologies
Most web browsers are set to accept cookies by default. You can choose to set your browser to remove or reject cookies, though this could affect certain features or services. If you have questions or comments about your privacy rights, email us at marie@hartworkai.com.
12. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you in a revised version of this Privacy Policy.
California law requires us to let you know how we respond to web browser DNT signals. Because there is not currently an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
13. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you, correct inaccuracies, obtain a copy, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law.

We may use your personal information for our own business purposes, such as undertaking internal research for technological development. This is not considered "selling" your personal information.
We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We will not sell or share personal information in the future belonging to website visitors, users, and other consumers.
Your rights
You have rights under certain US state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law. These rights include:
- Right to know whether or not we are processing your personal data
- Right to access your personal data
- Right to correct inaccuracies in your personal data
- Right to request the deletion of your personal data

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.
Request verification
Upon receiving your request, we will need to verify your identity. We will only use personal information provided in your request to verify your identity or authority to make the request. If we cannot verify your identity from the information we already maintain, we may request additional information for verification and security purposes.
If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request, and the agent will need to provide written and signed permission from you.
Appeals
Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at marie@hartworkai.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.
California "Shine The Light" Law
California Civil Code Section 1798.83 permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please contact us using the details in Section 15.

Yes, we will update this notice as necessary to stay compliant with relevant laws. We may update this Privacy Policy from time to time. The updated version will be indicated by an updated date at the top of this Privacy Policy. If we make material changes, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Policy frequently to stay informed of how we are protecting your information.
